1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you") and Rasim Eren Karakaş ("Developer," "we," "us") governing your use of the StarSport AI mobile application ("App," "Service").

By accessing or using the App, you confirm that you are at least 13 years of age (or 16 in the European Union), that you have the legal authority to enter into these Terms, and that you will comply with all applicable local, national, and international laws.

2. Description of Service

StarSport AI is an AI-powered mobile application that allows users to generate sports-themed visual content by applying generative AI techniques to user-provided photographs. Core features include:

• AI face-swap and image generation for sports media
• Template browsing across multiple sport categories
• A credit-based system for accessing generation features
• A free tier and optional Premium subscription
• User profile and generation history management

3. User Accounts

The App may assign you an anonymous session upon first launch or allow you to link an account via third-party identity providers. You are responsible for maintaining the security of your account. We reserve the right to terminate accounts that violate these Terms.

You agree not to share your account credentials, impersonate any person or entity, or create accounts using automated means.

4. User-Generated Content

By uploading any photograph, image, or other content to the App ("User Content"), you represent and warrant that:

• You own the content or have explicit permission from the person(s) depicted.
• The content does not depict any person under the age of 18 in a manner that could be construed as inappropriate.
• The content does not infringe any third-party intellectual property, privacy, or publicity rights.
• The content does not violate any applicable law or regulation.

You grant us a limited, non-exclusive, royalty-free license to process and transform your User Content solely for the purpose of providing the Service. We do not claim ownership of your User Content.

5. Prohibited Uses

You agree not to use the App to:

• Generate content that is defamatory, hateful, discriminatory, violent, or sexually explicit.
• Create non-consensual synthetic media (deepfakes) of real individuals.
• Violate any person's privacy, dignity, or right of publicity.
• Attempt to reverse-engineer, decompile, or extract source code from the App.
• Use automated scripts, bots, or scrapers to access the Service.
• Circumvent any credits, subscription, or access controls.
• Engage in any activity that disrupts or damages the App's infrastructure.

Violation of any prohibited use may result in immediate account termination and, where applicable, legal action.

6. Credits and Subscriptions

Credits: The App uses a credit system. Each AI generation consumes credits. Credits are non-transferable, non-refundable, and have no monetary value. Unused credits expire at the end of each subscription billing period.

Subscriptions: Premium subscriptions are available on a recurring basis (weekly or annual) and are billed through Apple App Store or Google Play Store. Prices are displayed at the point of purchase and are subject to change.

Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Cancellation: You may cancel your subscription at any time through your Apple ID settings (iOS) or Google Play account (Android). Cancellation takes effect at the end of the current billing period; no partial refunds are provided.

Refunds: All purchases are final and non-refundable, except as required by applicable law or Apple/Google refund policies.

7. Intellectual Property

The App, including its design, trademarks, codebase, AI models, and all content provided by us (excluding User Content), is the exclusive property of Rasim Eren Karakaş and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8. AI-Generated Content Disclaimer

AI-generated media should not be presented as real photographs without clear disclosure that the content is AI-generated.

9. Third-Party Services

The App integrates with third-party services including Supabase (database and authentication), fal.ai (AI inference), and Cloudflare R2 (media storage). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee the accuracy or reliability of AI-generated content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RASIM EREN KARAKAŞ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability to you shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rasim Eren Karakaş from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

13. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue the App or any feature thereof at any time. We may update these Terms from time to time. We will notify you of material changes by updating the "Effective Date" above and, where appropriate, via in-app notification. Continued use of the App after any changes constitutes your acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict-of-law principles.

Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of Istanbul, Turkey.
